Privacy Policy

This Privacy Policy explains what personal data American Pro Nutrition LLC processes when you contact us through this website, what we use it for and what your rights are. It applies to anyone who visits this site or submits the contact form, wherever you live.

1. Data controller

The data controller is American Pro Nutrition LLC, a limited liability company organized in Wyoming, United States, with offices at 6400 NW 74th St, Doral, FL 33166, USA. Email: sales@americanpronutrition.com. Phone: +1 786 887 9575.

2. Data we collect

We collect only what you voluntarily type in the contact form:

  • Name.
  • Company (optional).
  • Email address.
  • Phone / WhatsApp (optional).
  • Country and products of interest (optional).
  • Your message.

In addition, whenever the site is visited, the server transiently processes minimal technical connection data (for example IP address, browser, date and page requested) to deliver the site and protect it from abuse. American Pro Nutrition LLC does not store IP addresses or form contents in its application logs; the limit on submissions per IP address is applied only in server memory and is discarded immediately. The infrastructure provider may keep technical access logs under its own policies.

We do not ask for sensitive data (health, racial origin, beliefs, biometric or financial data). Please do not include it in your message. This site does not sell products and does not collect payment information.

3. Purposes

We use your data exclusively to:

  • Answer your inquiry and contact you by email, phone or WhatsApp.
  • Prepare distribution proposals and quotes for the products you asked about.
  • Keep a record of the business conversation you started.

We do not use your data for automated decisions, profiling or third-party advertising.

4. Consent and legal basis

Processing is based on your prior, express and informed consent, which you give by ticking the box “I have read and accept the Privacy Policy and authorize the processing of my data to answer my request” before submitting the form. The box is not ticked by default and the form cannot be sent without it. We keep proof of the authorization together with the request: the acceptance, the date and time, and the version of this policy in force at that moment.

You may withdraw your consent at any time, free of charge, through the channels in section 14. Withdrawal does not affect the lawfulness of processing carried out before it.

5. Retention

We keep your data for 24 months from your last contact with us, or until you ask for its deletion or withdraw your consent, whichever happens first. After that the data is deleted, unless a legal obligation requires us to keep it longer.

6. We do not sell or share your data

American Pro Nutrition LLC does not sell, rent or share your personal data with third parties for advertising or marketing purposes, and does not exchange it for any consideration. We only disclose it in the cases described in the next section or when a competent authority requires it by law.

7. Processors and third parties

  • Hosting provider: hosts the site and the database where requests are stored, acting on our behalf and under our instructions.
  • WhatsApp (Meta Platforms): only involved if you decide to continue the conversation on that channel, for example by pressing the WhatsApp buttons. That service is governed by WhatsApp/Meta terms and privacy policy, which are outside American Pro Nutrition LLC.
  • Authorities: only when there is a legally valid order or request.

8. Cookies and similar technologies

This site does not use cookies or trackers: no analytics, tracking pixels, advertising, third-party fonts or third-party scripts. All content, including typefaces, is served from our own domain. For that reason we do not show a cookie banner. The only item stored in your browser is your language preference (local storage), which is strictly functional and which you can delete at any time from your browser settings. If we add any such tool in the future we will update this policy and ask for your consent before activating it.

9. International transfers

Your data is hosted on servers of a hosting provider and may be processed outside your country of residence, including the United States. As a U.S. company serving customers in Latin America, the United States and elsewhere, transferring data to the United States is inherent to the service. We apply the security measures in section 12 wherever the data is processed.

10. Your rights

At any time and free of charge you may: know what data of yours we process and why; update and correct inaccurate data; request deletion; withdraw your consent; and request proof of the authorization given. To exercise them, write to us through the channels in section 14 stating your name and the email or phone you used, so we can identify you. We will not hand over data to anyone who cannot prove their identity.

If you live in Colombia (Law 1581 of 2012 and its regulations): you may file inquiries, which we will answer within ten (10) business days, and claims for correction, update or deletion, which we will answer within fifteen (15) business days, extendable as the law allows. If you consider that we did not properly address your claim, you may file a complaint with the Superintendencia de Industria y Comercio (SIC) once you have exhausted the process with the controller.

If you live in Venezuela: the legal system recognizes habeas data (article 28 of the Constitution): access to information about you held in records, to know its purpose and to demand rectification or destruction when inaccurate. Privacy and confidentiality are also protected (article 60). The channels in section 14 are available to exercise those rights.

If you live in California (U.S.): under the CCPA/CPRA you may request to know, correct and delete your personal data, and not to be discriminated against for exercising your rights. American Pro Nutrition LLC does not sell or share personal data as defined in those laws. In line with CalOPPA, this policy describes the data we collect and how it is used, and the site does not track visitors across websites.

If you live in the European Economic Area or the United Kingdom: you may also request restriction of processing, object to it, request portability of the data you provided and lodge a complaint with your data protection authority.

If you live in Mexico, Chile, Peru, Ecuador or another country with its own data protection law: we recognize the rights that law grants you (for example access, rectification, cancellation and objection — ARCO — in Mexico) and will handle them through the channels below.

11. Minors

This site and our services are intended for adults aged 18 or over and for businesses. We do not knowingly collect data from persons under 18. If you believe a minor has sent us their data, contact us so we can delete it.

12. Security

We apply reasonable technical and organizational measures to protect your data: transmission uses an encrypted connection (HTTPS), access to requests is restricted to authorized staff and the files containing them are stored with restricted permissions on the server. No system is completely infallible; if a security breach affecting your personal data occurs, we will notify the persons and authorities concerned as required by applicable law, including the breach notification rules of the State of Wyoming.

13. Changes to this policy

We may modify this policy to reflect legal or operational changes. The current version and its date are shown at the top of this page. Each request is linked to the version you accepted. If the changes substantially affect the use of your data we will ask for your consent again.
